The System provides developmental assessment questionnaires, assessment results, progress monitoring, general recommendations, suggested pediatricians or clinics, appointment scheduling, communication, notifications, and other features made available through the System. If you are using KinderCura to create or manage a profile for a child, you represent that you are the child's parent or legal guardian or otherwise have the appropriate authority to provide and manage the child's information through the System. If you do not agree to these Terms, you must not access or use KinderCura. KinderCura may update these Terms from time to time. Continued use of the System after an updated version becomes effective constitutes acceptance of the revised Terms, where permitted by applicable law. ________________________________________ 3. Users must not use the System to engage in unlawful activities, attempt to gain unauthorized access to accounts or System resources, bypass security controls, interfere with the operation of KinderCura, introduce malicious software or code, or knowingly provide false or misleading information. Users must not access, copy, disclose, distribute, modify, or misuse another user's or child's personal information without proper authorization. Users must not use KinderCura to upload, transmit, or distribute content that they do not have the right or authority to submit. Users must not use assessment results generated by KinderCura as a substitute for professional medical evaluation or use the System in a manner that may reasonably cause harm to another person. KinderCura reserves the right to restrict access to the System when there is a reasonable basis to believe that a user has violated these Terms, applicable law, or the security or privacy of other users. ________________________________________ 5. ACCOUNT REGISTRATION AND SECURITY Certain KinderCura features require users to create an account. Users agree to provide accurate, complete, and current information during registration and to update their information when necessary. Users are responsible for maintaining the confidentiality of their account credentials and for activities performed through their account. Users must not knowingly share their passwords or other account credentials with unauthorized individuals. If a user suspects that their account has been accessed or used without authorization, the user should promptly contact the KinderCura system administrator or the designated support contact. KinderCura may suspend or restrict an account when necessary to protect the System, its users, or personal information, including when an account is suspected of being compromised or misused. ________________________________________ 6. USER CONTENT AND INTELLECTUAL PROPERTY Users may submit information and content to KinderCura in connection with the features they use. This may include child profile information, assessment responses, assessment-related information, appointment information, communications, and child videos where such uploads are supported by the System. Users remain responsible for the information and content they submit and represent that they have the appropriate authority to provide such information or content to KinderCura. By submitting information or content to KinderCura, the user grants the System the permissions necessary to collect, store, process, display, and use that information for the purposes associated with the applicable System feature, subject to the KinderCura Privacy Notice and applicable law. Unless otherwise stated, the KinderCura software, interface, system design, logos, branding, original materials, documentation, and other System content are owned by or licensed to the organization responsible for KinderCura. Use of KinderCura does not transfer ownership of the System or its intellectual property to the user. Users must not reproduce, modify, distribute, sell, reverse engineer, or otherwise misuse KinderCura's protected software, content, branding, or other intellectual property except where permitted by applicable law or expressly authorized by the System owner. ________________________________________ 7. PRIVACY AND COOKIES KinderCura collects and processes personal information as necessary to provide and operate its services. Information processed through the System may include account information, child profile information, assessment responses and results, progress records, appointment information, communications, notifications, and uploaded child videos, depending on the features used by the user. KinderCura processes personal information in accordance with its Privacy Notice and applicable Philippine privacy laws and regulations, including Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012. The KinderCura Privacy Notice provides additional information regarding the types of information collected, purposes of processing, access and sharing, retention, security measures, automated processing, data subject rights, and other privacy-related matters. Where KinderCura uses cookies or similar technologies, these may be used for purposes such as maintaining sessions, supporting authentication, remembering necessary settings, improving System functionality, or maintaining security. Any non-essential cookies or similar technologies that require user choice shall be handled in accordance with applicable privacy requirements and the applicable privacy notice. Users should review the KinderCura Privacy Notice for more detailed information regarding the System's privacy practices. ________________________________________ 8. MACHINE LEARNING AND AUTOMATED PROCESSING KinderCura may use machine learning and other automated processing technologies as part of the development, testing, evaluation, research, improvement, or enhancement of certain System functions. Automated processing may be used to support functions such as assessment-related processing, analysis, recommendations, or future improvements to the System, depending on the features implemented by KinderCura. Where user-provided information is considered for machine learning-related purposes, such processing shall be conducted in accordance with the applicable privacy requirements and the choices presented to the user. Any consent requested specifically for machine learning-related use of eligible user-provided information is separate from acceptance of these Terms. Users may decline optional machine learning consent without that decision, by itself, preventing them from accepting these Terms or using KinderCura features that do not require such optional processing. ________________________________________ 9. MEDICAL AND DEVELOPMENTAL DISCLAIMER KinderCura is a developmental assessment and monitoring support system. It does not provide medical diagnosis, medical treatment, therapy, or emergency medical services. Assessment results generated by KinderCura are based on information submitted by users and the assessment methods implemented within the System. Results may therefore be affected by the accuracy and completeness of the information provided. Recommendations and suggested activities provided through KinderCura are general in nature and should not be considered medical instructions or a substitute for professional advice. Parents and legal guardians should consult a qualified healthcare professional when they have concerns about a child's health or development. Any diagnosis, medical advice, treatment, or professional evaluation provided by a pediatrician or other healthcare professional is the responsibility of that professional. In an emergency or situation requiring immediate medical attention, users should contact the appropriate healthcare or emergency service rather than relying on KinderCura. ________________________________________ 10. APPOINTMENTS AND PEDIATRICIAN SERVICES KinderCura may provide features that allow parents or legal guardians to view suggested pediatricians or clinics and request appointments. KinderCura does not guarantee that a particular pediatrician or clinic will be available, accept an appointment request, or provide an appointment at the requested date or time. Appointment scheduling, consultation availability, cancellation, and other related matters may be subject to the policies of the participating pediatrician or clinic. KinderCura does not control or guarantee the medical services provided by independent healthcare professionals. ________________________________________ 11. DISCLAIMER OF WARRANTIES KinderCura is provided on an "as is" and "as available" basis, to the extent permitted by applicable law. While reasonable efforts may be made to maintain the accuracy, security, and availability of the System, KinderCura does not guarantee that the System will always be uninterrupted, error-free, secure, or available at all times. KinderCura does not guarantee that assessment results, recommendations, or other System outputs will identify every developmental concern or be suitable for every individual child. Information provided through the System should be considered within the limitations described in these Terms and the KinderCura Privacy Notice. Nothing in these Terms is intended to exclude any warranty, right, or protection that cannot lawfully be excluded under applicable law. ________________________________________ 12. LIMITATION OF LIABILITY To the extent permitted by applicable law, KinderCura and the organization responsible for the System shall not be liable for indirect, incidental, consequential, special, or other damages arising from or related to the use of, inability to use, or reliance upon the System or information provided through the System. This includes, where permitted by law, losses resulting from service interruptions, technical errors, unauthorized access, inaccurate information submitted by users, reliance on assessment results or recommendations, or the unavailability of a pediatrician or appointment. Nothing in these Terms shall be interpreted as excluding or limiting liability where such exclusion or limitation is prohibited by applicable Philippine law. ________________________________________ 13. ACCOUNT SUSPENSION AND TERMINATION KinderCura may suspend, restrict, or terminate a user's access when there is a reasonable basis to believe that the user has violated these Terms, misused the System, attempted unauthorized access, provided fraudulent information, created a security risk, or engaged in conduct that may harm the System or another user. Users may request the closure of their account through the procedures provided by KinderCura. Termination or closure of an account does not necessarily require the immediate deletion of all information associated with the account where retention is required or otherwise permitted under applicable law or the KinderCura Privacy Notice. ________________________________________ 14. CHANGES TO THE SYSTEM AND THESE TERMS KinderCura may update, modify, suspend, or discontinue portions of the System when reasonably necessary for maintenance, security, development, operational requirements, or other legitimate purposes. KinderCura may also revise these Terms to reflect changes to the System, applicable laws, privacy requirements, security practices, or other operational matters. The Last Updated date displayed at the end of these Terms indicates when the Terms were most recently revised. Where appropriate and required by applicable law, users will be provided with notice of material changes before the revised Terms take effect. ________________________________________ 15. GOVERNING LAW AND DISPUTE RESOLUTION These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines. The parties shall first attempt to resolve any dispute or concern relating to the use of KinderCura through good-faith communication with the designated KinderCura system administrator or organization responsible for the System. Where a dispute cannot be resolved through such communication, the matter may be referred to the appropriate Philippine court, government agency, or other dispute-resolution mechanism having jurisdiction over the matter. Nothing in this section prevents a user from exercising any rights or remedies available under applicable Philippine law. ________________________________________ Effective Date: October 11, 2026 Last Updated: October 11, 2026 Version: 1.0
